Client Services
We are regularly called upon by our clients to assist with the following tasks:

  • Buying and selling of timberlands and manufacturing facilities throughout the United States
  • Negotiating agreements related to the operation of timberlands such as road use and maintenance agreements, rights-of-way and easements, log and fiber supply agreements, logging and hauling contracts, access permits and licenses, leases, etc.
  • Negotiating and documenting loans secured by timberlands and manufacturing facilities and products
  • Conducting and overseeing environmental audits
  • Consulting on environmental issues related to forestland and mill ownership and operations, including agency negotiation and related remediation and cleanup
  • Interpreting current law and policy trends in the area of sustainable forestry and advising on issues of carbon sequestration, biomass facilities and contracts, BCAP, conservation easements and water resources
  • Negotiating conservation easements
  • Negotiating alternative revenue stream transactions (highest and best use sales, wind, solar and other energy projects, etc.)
  • Assisting with litigation and alternative dispute resolution of forestry and forest product disputes
  • Defending or prosecuting claims on behalf of timberland owners involving a variety of matters such as adverse possession, timber trespass, land use, and tort and breach of contract claims
  • Defending workers' compensation claims
  • Advising on tax and regulatory compliance issues related to ownership of timberlands and mills
  • Developing, refining and tailoring forestry related policies, including FSC, Lacey Act and chain of custody strategies
  • Assisting clients with product distribution, including warranties, disclaimers, labeling and CARB and Proposition 65 disclosures and Internet limitations
  • Formulating intellectual property acquisition, licensing and enforcement strategies, including patents, trademarks and protection of trade secrets and know-how
  • Advising timberland and TIMO clients with respect to capital formation process and private placements of timber-related investment funds
  • Negotiating timberland investment management agreements
  • Giving advice on lumber grading standards, certification marks protection, and products liability defense
  • Advising on antitrust issues related to timber and log purchasing and product sales, including private party litigation, agency investigation and criminal prosecution
