Industry focus

How I represent clients at Schwabe

My focus is on environmental and real estate concerns that center on the renewable energy, agriculture, and forest products sectors. I help clients with land use, real estate transactions, and regulatory matters that govern clean water, clean air, forest management, and environmental policy. A tailored approach to legal concerns is a hallmark of how I practice law.

I have assisted clients with the legal issues involving wind and solar development, energy transmission lines, and agricultural property transactions, as well as the acquisition and disposition of timberlands. I have also counseled clients on land use questions related to utility substations and battery storage systems.

Experience

  • Facilitated title work and assisted in the acquisition of prime real property for commercial clients.
  • Advised a client who proposed to develop a renewable natural gas facility through the Oregon Energy Facility Siting Council (EFSC) approval process.
  • Represented an industrial client in communications with the Oregon Department of Environmental Quality (DEQ) in relation to air quality emissions.
  • Advised a client on Oregon DEQ enforcement relating to potential groundwater contamination.
  • Advised a client on requisite air permits for installation of carbon capture and storage technology onto existing facility.
  • Conduct land use due diligence for various clients across Oregon when they seek to explore development options on property, including battery energy storage systems and substations for a regulated electric utility company.
  • Advised clients on the land use permitting process for numerous developments across Oregon.
  • Drafted land use permit applications for various land use approvals authorizing new developments.
  • Drafted arguments supporting a client’s renewable diesel facility development, including responses to public comments.
  • Advised a solar developer on land use approval requirements that related to Statewide Planning Goals and impacts to surrounding land.
  • Represented clients across central Oregon in relation to code enforcement cases that pertained to use of property and development proposals.
  • Conducted legal research and produced written memoranda in various areas of law.
  • Drafted a public comment relating to Clean Water Act (CWA) Section 401; conducted legal research on environmental statutes, including CWA, Clean Air Act (CAA), National Environmental Policy Act (NEPA), and National Forest Management Act (NFMA).
  • Authored memoranda relating to environmental statutes, and contributed to court briefs.
  • Assisted a nonprofit environmental organization with the public commenting process.
  • Drafted a complaint that addressed CWA violations.
