How I represent clients at Schwabe
As the previous leader of Schwabe’s Real Estate and Construction industry group and as a Shareholder in our Litigation Department, I help owners, developers, contractors, and design professionals resolve disputes at the administrative level, in arbitration, and in court. I also guide clients through the public works bidding process and regularly assist with bid protests. Drafting and negotiating contracts is another area of focus, including frequent presentations on these topics to industry groups, bar associations, and clients.
Legal advice with an in-house perspective
I am former in-house counsel to a national electrical utility contractor with experience in all aspects of project development and claims resolution. This experience makes me a more effective advocate because I understand and appreciate our clients’ business priorities and the value I bring to every matter.
Experience
Litigation and Dispute Resolution
- Secured arbitration award on behalf of general contractor on payment claim against project owner, and successfully defended against counterclaim for liquidated damages.
- Obtained unanimous jury verdict on a payment bond claim relating to work performed on a public works construction project on behalf of specialty subcontractor.
- Secured summary judgment determination in favor of marine contractor on complex public works project.
- Successfully resolved dispute regarding change order claims on high-profile public infrastructure project on behalf of international engineering firm.
- Represented several architecture firms in payment disputes, including defense against counterclaims and third-party claims.
- Successfully resolved payment claim on behalf of specialty subcontractor.
- Achieved favorable settlement in dispute between civil contractor and City of Portland involving issues of defect and delay.
- Successfully prosecuted construction defect claims on behalf of commercial property owner, achieving favorable settlement.
- Represented real estate developer in defending against payment claim by design professional and pursued associated counterclaims.
- Defended national electrical utility contractor in complex construction litigation involving claims for breach of contract and delay.
- Assisted several contractor clients in filing and defending against bid protests.
- Successfully appealed issuance of occupational safety and health (OSHA) citations based on serious injury incidents on behalf of national electrical utility contractor.
Contract Drafting and Negotiation
- Draft and negotiate contracts between owners and design professionals (architects and engineers), including but not limited to AIA contracts.
- Draft and negotiate teaming agreements, prime contracts, subcontracts, and purchase orders for commercial and residential property owners, contractors, and subcontractors, including but not limited to AIA and ConsensusDocs contracts.
- Routinely assist owner, contractor and design professional clients in drafting suite of contract forms for use on development and construction projects in Oregon and Washington.
- Assisted project teams in drafting and negotiating construction contracts for use in building professional sports facilities.
- Advised renewable energy developer with issues related to construction of battery storage systems (BESS) projects.
