How I represent clients at Schwabe

I am trusted counsel to clients in intellectual property matters and complex commercial transactions, with a particular focus on the consumer products and natural resources industries.

I deliver practical guidance on the selection, registration, and enforcement of trademarks in ‎the United States (and work with foreign counsel to do the same across the globe), copyright protection and enforcement, internet domain name ‎disputes, the transfer and licensing of intellectual property rights, joint development agreements, and IP due diligence for mergers ‎and acquisitions. I study the latest developments in intellectual property law so that I can deliver efficient and innovative solutions for my clients.

I serve as lead counsel on complex commercial transactions with intricate deal structures and novel issues, and train and supervise teams of attorneys to support commercial contracting workflows for high-volume procurement and sales departments. Clients rely on me for everything from carbon project development agreements and purchase agreements, involving both private and public entities and both regulatory and voluntary markets, to the implementation of new ERP software solutions across hundreds of retail locations, deals for the purchase and processing of raw materials for manufacturing plants around the country, and agency and licensing agreements to introduce products into new markets. I relish any opportunity to develop a creative solution and implement it via thoughtful and tailored agreements, but I also understand when standardized and streamlined is the best way to achieve a client’s objectives. In all situations, I hone in on the heart of each transaction, to find diplomatic and fair solutions to issues large and small.

Experience

Intellectual Property

  • Successfully defended international software application developer’s rights in a multi-jurisdictional trademark dispute involving multiple trademark offices and platform owners.
  • Successfully represented clients in disputes before the Trademark Trial and Appeals Board and under the Uniform Domain-Name Dispute-Resolution Policy.
  • Manage the trademark portfolio of an international timber products company.
  • Managed a years-long enforcement campaign protecting a market leader’s brand against frequent third-party infringement.
  • Advise on advertising compliance issues in product packaging design and marketing campaigns for national consumer products companies.
  • Secured important trade dress protection for a client’s signature shoe design.

Carbon Development and Transactions

  • Negotiate carbon project development agreements with private and public landowners, involving regulatory and voluntary markets.
  • Advised multiple clients on the implementation of platforms for online sales of carbon credits.

Commercial Transactions

  • Routinely serve as lead counsel on implementations of complex enterprise software solutions, for both private and public licensees.
  • Train and manage teams of attorneys to handle commercial contracting needs for clients in a variety of industries, overseeing and coordinating commercial contracting workflows for high-volume procurement and sales departments.
  • Serve as outside contracting counsel to multiple industry-leading SaaS companies, negotiating software license agreements, SLAs, and data privacy addendums against Fortune 500 companies.
  • Update and streamline contracting libraries and playbooks for local, regional, national, and international companies.
